Were you injured while on-the-job? Are you missing days or weeks of work? Are you trying to deal with pain, medical treatment, and mounting bills? How will you and your family survive?
In case you aren’t aware, New Jersey workers’ compensation law provides income benefits for injured workers, like yourself. These benefits will cover a portion of your income lost as a result of your workplace injuries.
Once you file your claim, you should receive your first wage compensation check within two weeks. What will you receive? You are entitled to compensation equal to a percentage of your weekly salary. A benefit is typically 70 percent of lost wages, but can go as high as 80 percent, depending on the circumstances.
Your lost income benefits will continue until you are found to be medically fit to return to work by your physician. If you reach your maximum medical improvement and are still not able to return to work, you may be able to apply for permanent disability.
Keep in mind, it doesn’t matter who was at fault for your work-related injuries. You are still entitled to a percentage of your weekly salary. Even if your employer doesn’t carry workers’ compensation insurance, the New Jersey Uninsured Employers’ Fund will pay your income benefit.
In New Jersey, there are three types of Workers’ Compensation Benefits available:
- Medical benefits – your employer has the right to choose the doctors where you receive treatment
- Temporary disability benefits – the rate is set by the average weekly salary you earn
- Permanency award – comes after your treatment is terminated and is based on a percentage of disability
